Immigration-Eligible Employment Visas

Not all employment-based visas lead to permanent residency, but certain categories in the EB (Employment-Based) visa series can put you on a path to a green card.

If you hold an advanced degree or have demonstrated strong ability in your profession, you may be eligible for an EB-2 visa. In most cases, your employer must prove that no qualified U.S. worker is available for the role—unless your work is considered to be in the national interest.

There are also options for skilled workers and individuals with a bachelor’s degree under the EB-3 category, provided the same condition applies—that no qualified U.S. worker is available.

Another option is the EB-1C visa, which applies to multinational managers and executives. If you’ve worked in that capacity for at least one of the last three years and are transferring to a related company in the U.S., you may qualify.

At Buenaventura Koss, PLLC, we help individuals and businesses explore these pathways and take the right steps toward employment-based immigration. Schedule a consultation with office to find out if one of these options is right for you.

Non-Immigration Employment Visas

Even if you don’t qualify for a visa that leads to permanent residency, you may still be eligible to work in the U.S. on a temporary basis through one of several employment-related visa categories. These visas—often referred to by their letter designations—include B, E, H, L, O, P, R, and TN.

You may qualify for one of these options if you:

  • Have certain knowledge and are applying for a temporary specialty occupation visa
  • Are a high-level employee transferring to a U.S. branch of your company
  • Possess exceptional abilities in the arts, sciences, business, education, or athletics
  • Are a Canadian or Mexican citizen in a qualifying professional field under the TN visa
  • Need to enter the U.S. for business activities without accepting employment
  • Are involved in religious work, entertainment, or other specific sectors

At Buenaventura Koss, PLLC, we help individuals and businesses determine which type of temporary employment visa fits their goals and qualifications. If you're looking to come to the U.S. for work or business-related purposes, contact our office to schedule a consultation.
