Do I Qualify for a Fiancé (K-1) Visa?

If you’re engaged to someone who is not a U.S. citizen, the K-1 fiancé visa may allow you to bring them to the United States so you can begin your life together.

This visa allows your fiancé to:

  • Enter the United States legally
  • Marry you within 90 days of arrival
  • Apply for a green card after marriage

Who Qualifies for a K-1 Visa?

To qualify for a K-1 visa, you must meet several key requirements:

1. You Must Be a U.S. Citizen

Only U.S. citizens—not permanent residents—can sponsor a fiancé for a K-1 visa.

2. You Must Intend to Marry Within 90 Days

You and your fiancé must both have a genuine intention to marry shortly after arrival in the U.S.

3. You Must Have Met in Person

In most cases, you must have met your fiancé in person within the last two years (with limited exceptions).

4. You Must Have a Real Relationship

You must prove your relationship is legitimate, not solely for immigration purposes.

Evidence may include:

  • Photos together
  • Travel records
  • Messages or communication history
  • Statements from friends or family

5. You Must Meet Financial Requirements

You must show that you can financially support your fiancé after they arrive in the U.S.

This typically involves filing an Affidavit of Support.

What Happens After You Apply?

The K-1 visa process involves several steps:

  1. Filing Form I-129F
  2. USCIS review and approval
  3. Consular interview abroad
  4. Entry into the U.S.
  5. Marriage within 90 days
  6. Applying for a green card

Each step requires careful preparation and accurate documentation.

Common Reasons K-1 Visas Are Delayed or Denied

Even eligible applicants can face issues if:

  • Forms are incomplete or incorrect
  • Documentation is missing
  • The relationship is not clearly proven
  • Deadlines are missed

Attention to detail is critical throughout the process.

Do You Need an Immigration Lawyer?

While it is possible to apply on your own, many couples choose to work with an attorney to:

  • Avoid costly mistakes
  • Ensure all documentation is complete
  • Navigate complex requirements
  • Reduce delays
